- Acceptance of Terms
By accessing or using this website and booking any tour, you agree to be bound by these Terms and Conditions (“Terms”).
These Terms constitute a legally binding agreement between you (“Client,” “Traveler,” or “You”) and Encore Travel Alliance (“Company,” “We,” “Us,” or “Our”).
- Booking and Payment
2.1 Booking Confirmation
A booking is confirmed only after:
- A completed reservation form is submitted; and
- The required deposit or full payment is received.
You will receive a confirmation email once your booking is secured.
2.2 Deposits
A non-refundable deposit of $200 per person is required at the time of booking unless otherwise stated. Deposits will not be refunded, but they will be held as a credit for two years. A credit may be used for yourself or another traveler. Additionally, your credit may be converted to a scholarship donation, even after the two year expiration date.
2.3 Final Payment
Full payment is due 120 days before the tour departure date. Failure to pay may result in cancellation without refund or exchange of deposit.
2.4 Pricing
All prices:
- Are listed in Dollars.
- May change without notice prior to booking confirmation.
- May be subject to exchange fees, service fees, or government charges. Any such charges will be clearly stated in the tour description.
- Cancellation and Refund Policy
3.1 Cancellation by Client
Refunds (if applicable) are as follows:
- More than 120 days before departure: 75% refund
- 120-30 days before departure: 25% refund
- Less than 30 days before departure: No refunds
- Cancellation insurance is available. If you would like to guarantee a refund of your tour due to circumstances beyond your control, ask us about Cancellation Insurance.
Deposits are non-refundable unless otherwise stated. See 2.2 Deposits
3.2 No-Show Policy
Failure to appear on the tour date will be considered a no-show and no refund will be issued.
3.3 Cancellation by Company
We reserve the right to cancel a tour due to:
- Insufficient participants
- Weather conditions
- Safety concerns
- Force majeure events
In such cases, you will be offered:
- A full refund; or
- An alternative tour date
We are not responsible for incidental expenses (flights, accommodation, visas, etc.).
- Changes and Modifications
4.1 Changes by Client
Requests to modify bookings are subject to availability and may incur additional fees.
4.2 Changes by Company
We reserve the right to:
- Adjust itineraries
- Substitute accommodations
- Modify transportation
- Change departure times
Such changes will be made only when necessary and in the interest of safety or operational needs.
- Travel Requirements
Clients are responsible for:
- Valid passports and visas
- Travel insurance
- Required vaccinations
- Compliance with local laws and regulations
We strongly recommend purchasing comprehensive travel insurance.
- Health and Safety
By participating in our tours, you acknowledge:
Travel involves inherent risks.
You are physically and medically fit for the activities booked.
You will follow all safety instructions provided by guides.
- Liability Disclaimer
To the fullest extent permitted by law:
- The Company acts as an intermediary between clients and third-party service providers (hotels, transportation, restaurants, etc.).
- We are not liable for injury, loss, damage, accident, delay, or irregularity caused by third-party providers.
- We are not responsible for delays, natural disasters, government actions, pandemics, or force majeure events.
Our total liability shall not exceed the amount paid for the tour.
- Code of Conduct
Participants shall:
- Respect local customs and laws.
- Follow guide instructions.
- Treat fellow travelers respectfully.
- Intellectual Property
All content on this website, including:
- Text
- Images
- Logos
- Branding
- Itineraries
is the intellectual property of Encore Travel Alliance and may not be copied, reproduced, or distributed without written permission.
- Privacy Policy
By using this website and participating in tours, you agree to our Privacy Policy regarding the collection and use of personal information.
We may collect:
- Contact details
- Payment information
- Travel preferences
- Group Photographs
Your information will not be sold to third parties.
Force Majeure
We are not liable for failure to perform obligations due to events beyond our control, including but not limited to:
- Natural disasters
- War
- Government restrictions
- Pandemics
- Transportation disruptions
Governing Law
These Terms are governed by the laws of Missouri, without regard to conflict of law principles.
Any disputes shall be resolved in the courts of Jackson County.
Dispute Resolution
Before initiating legal action, both parties agree to attempt resolution through:
- Written notice of dispute
- Good faith negotiation
- Mediation (if applicable)
Severability
If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
Amendments
We reserve the right to update these Terms at any time. Updated versions will be posted on this page with a revised “Effective Date.”
Continued use of the website constitutes acceptance of revised Terms.
